I, Jeremiah Smith of the County of Knott and State of Ky of the age of 56 years and being of (?sound?) and disposing mind and memory do make, publish and disclose that my last will and testament in the manner following.
First, I direct my executors hereinafter named to pay out of my estate as soon as possible after my decease all my just debts with my burial expense.
Second, I give and devise to my oldest boy, Roscoe Smith $402.50 one half of the (?fund?) deposited by Kennis Hensley in the Hindman Bank.
Third, I give and devise to my youngest boy, Goodloe Smith $402.50 the other half deposited to my credit by said Hensley in said Bank. This being this part of my real estate as requested by me.
I hereby appoint Kennis Hensley the sole Executor of this my last will hereby revoking all former wills by me at any time made.
In witness whereof I have hereunto set my hand and seal this 7 day of December A.D. 1905

The foregoing instrument was at the date thereof signed, sealed, published and declared by the said Testator, Jeremiah Smith as and for his last will and testament in the presence of us. Who at his request in his presence and in the presence of each other have subscribed our names as witness thereto.

I, R. H. Amburgey, Clerk of the County Court do certify that the foregoing will of Jeremiah Smith was this day produced in open court and approved by M. F. Kelly, Cordia, Ky. and Richard Smith, Smithsboro, Ky. two subscribing witness thereto and the same was duly admitted to probate by the Hon. Judge of the County Court of said county

Now comes Kenny Hensley (?___?) in (?open court?) (Will Book 1 Page 35) tenders and offers to probate the last will and testament of Jeremiah Smith Dec. which was proved in open court by the oath of M.F. Kelly one of the attesting witnesses to same and who testifies that in his presents and in the presents of Richard Smith the other attesting witness to said will that Jeremiah Smith signed and acknowledged said will to be his act and deed.
