LAST WILL AND TESTAMENT

DANIEL HAYS

Know all men by these presents that I Daniel Hays of Knott County Kentucky being in feeble health but sound in mind do make this my last will and testament.

I will and bequeath to my son Jiddy Hays on tract of land containing one hundred acres adjoining the lands of WM Kelly & LJ Perkins and patented in the name of Joseph E. Cornett, to have and to hold the same forever.

I also will and bequeath to Jiddy Hays 1 note of John B. Hays amounting to $67.50 being the bal. due on a note of $100.00.

I will and bequeath to my son Daniel Hays Jr. and Aleatha Maggard my home farm to be divided equally between them giving to my daughter Aleatha the house in which I live and the garden as well as all the buildings in addition to one half of the farm. That is I want my daughter Aleatha to have my house and buildings as well as garden, the remainder of my home farm to be divided equally between my son Daniel and daughter Aleatha as aforesaid.

They are to have and to hold said land forever to sell or dispose of the same or do as they see fit and I relinquish all my rights, titles, and interest as aforesaid.

To my son Epperson Hays, John B. Hays, Hezekiel Hays, Angelene Hays, I have made suitable pensions heretofore and do not intend to provide or will them any property or interest in any real estate as I think I have made provisions for them heretofore.

In testimony whereof I have hereto set my hand this the 13th day of January 1887.

I G.P. Combs clerk of the county court for the county & state aforesaid certify that the will of Daniel W. Hays was produced in open court by L.J. Perkins and R.S. May two subscribing witnesses thereto and the same being duly admitted to probate was ordered to be recorded and I further certify that I have this day recorded said will.
