Last Will and Testament of A.W. Amburgey

I A. W. Amburgey a resident of Pinetop, County of Knott, and State of Kentucky, being of sound mind and memory do hereby constitute this instrument of writing my last will and testament.

First, I order and direct that my executors hereafter made pay all my just debts and burial expenses as soon after my death as conveniently.

Second: I will and bequeath to my wife, Marinda Amburgey full control of the following described property so long as she remains single and a virtuous woman and at her death or upon her failure to comply with requirements of this instrument of writing said described property shall be delivered to my two daughters Nancy Amburgey and Rebeckey Amburgey.

Situated on Mallet fork of Carrs fork on the North fork of the Kentucky River. Beginning at a Bargelly tree at mouth of Branch at the house up the branch about 60 yds between the house and barn then up through the orchard to the center of the point at the back of orchard, then with said point to top of mountain between Branhams Creek and Mallet. Thence with top of ridge and John P. Slone's line to H.H. Smith's and B.F. Combs line. Thence with said line to Mallet fork. Thence down Mallet fork to the beginning. I also will to my wife Marinda Amburgey one half of my sang and yellow root and my wife is to pay one half of all my indebtedness. I will to my son Corbet Amburgey the following described property to wit

Beginning at a Bargelly tree at mouth of drane new house thence up drane about 60 yds. Thence up through the orchard to the center of the point at the back of orchard. Thence with point to top of mountain. Thence with top of ridge with line of John P. Slone, Joseph Reynolds to Sam William's line. Thence with Sam William's line down the spur to Ada Slone's line. Thence Ada Slone's line to Mallet fork. Thence up Mallet fork to the beginning. I also will to my son Corbet Amburgey one half of my sang and yellow root, he is to pay one half debts and also he is to pay out of the sang and yellow root one Hundred dollars each to my daughters Corsie Amburgey and my daughter Uarta Amburgey and AB Smith. My son Corbet Amburgey is to pay my daughter Maudie Lawhorn one hundred and fifty dollars and my daughter Corsie Amburgey one hundred and fifty dollars and my daughter Uarta Amburgey one hundred and fifty dollars.

This amount one Hundred and fifty dollars each to my three oldest daughters is to be all their part in my real estate which I will to my son.

Subscribed and attested by us and in the presents of the testator and in the presents of each other and the same was acknowledged by the testator in our presents.

Order of Probate In the matter of the probate of the last will and testament of  A. W. Amburgey deceased

It appearing to the satisfaction of the court from the evidence of Corsie Amburgey and J. L. Slone that the deceased A. W. Amburgey departed this life on the --- day of January 1922 domiciled at the time of his death in Knott Kentucky leaving as his last will and testament the forgoing instrument of writing which was this day filed in this court and offered for probate.

Whereupon came Corsie Amburgey and J. L. Slone two subscribing witnesses thereto and after being duly sworn stated that the instrument of writing was and is the last will and testament of the deceased A. W. Amburgey and that the said A.W. Amburgey signed, acknowledged, and declared the said instrument of writing his last will and testament in presents of the said subscribing witnesses, Corsie Amburgey and J. L. Slone and that the said subscribing witnesses signed and attested said instrument of writing as witnesses thereto in the presents of said
A. W. Amburgey and at his request and in the presents of each other.

Now therefore it is ordered that the said instrument of writing is and the same is now adjudged to be the last will and testament of the said A. W. Amburgey and the same is hereby admitted to probate as such and ordered to be recorded and admitted to court as the last will and testament of the said A. W. Amburgey, deceased.
