Deputy Sheriff Thomas Griffey to Owen G Cates & Henry L Edrington

 

This indenture made this 7th day of September in the year 1829 between Thomas Griffey deputy for Richard Roger Sheriff of the County of Hickman in the state of Kentucky of the one part and Owen G Cates & Henry L Edrington of the county and state aforesaid of the other part. Witnesseth that whereas William T Walker sued out of the clerk’s office of the Fayette Circuit Court a writ of Fienfacias against the Estate of John T Mason Jr. for the sum of Fourteen hundred dollars debt with Interest therein from the first of January 1824 til also eight dollars and 21½ cents costs bearing date the 26th of May 1829 returnable to the 24 day of August next; Rules of said Circuit Court which fierefacias was directed and delivered to the Sheriff of Hickman County & the said deputy Sheriff by virtue of the fierefacias aforesaid levied the same in a certain piece or parcel of land as the Estate of the said John T Mason Jr. and believing failed to give bond and security for the payment of the said debt, interest & costs the said deputy Sheriff as aforesaid in pursuance of said writ and according to the laws of said state having legally advertised and made known the same did on the 7th day of September 1829 in the county aforesaid Exposed the sale by public virtue or auction the aforesaid tract of land with the appurtenances and all the estate right title and demand whatsoever of him the said John T Mason Jr. in to and ever the same and whereas the said O.G. Cates and Henry L Edrington did then and there bid the sum of one hundred and thirty two dollars and no person bidding more the said tract of land and appurtenances was is duo form and manner (?)(?) off and sold to the said O.G. Cates & H.L. Edrington for the said sum of $132 therefore to confirm the said purchase to the said O.G. Cates & H.L. Edrington as aforesaid made: This Indenture Witnesseth that the said Thomas Griffey deputy for Richard Roger  Sheriff of the county aforesaid for and in consideration of the sum of one hundred and thirty two dollars to him in hand paid the receipt whereof is hereby acknowledged hath given granted bargained sold released conveyed and confirmed and by these presents does give grant bargain sell release convey and confirm unto the said O.G. Cates & H.L. Edrington their assigns forever all that tract or parcel of land situate in the county aforesaid and known & designated as follows (Viz) it being an individed half of a nine hundred acre survey surveyed in the name of Edward Druse and Patented to the heirs of Stephen T Mason and adjoining the Town of Columbus or the tract of land on which said Town is situated on the East side thereof with the appurtenances to the same belonging or in any wise appertaining with all the estate right and title intered property claim and demand of the said John T Mason Jr. into and over the same and every part and parcel thereof: to have and to hold all and singular the above granted and bargained premises and appurtenances to the said Owen G Cates and Henry L Edrington their heirs and assigns to the only proper use and benefit behalf of the said O.G Cates and H.L. Edrington their heirs and assigns forever, in as (?) and a useful manner. I the said Thomas Griffey by Virtue of the authority aforesaid might convey or aught to convey the same. In testimony whereof I have hereunto set my hand the date above written.

Hickman County To Wit:

I, Henry L Edrington clerk of the county court for the county aforesaid do certify that on this day the foregoing deed from Thomas Griffey deputy for Richard Roger Sheriff of Hickman County & State aforesaid to OG Cates and HL Edrington was produced come and acknowledged by the said grantor to be his act deed for the ? therein mentioned. Whereupon the same together with the foregoing certificate hath been duly recorded in my office.
