Commonwealth vs Samuel P McFall

The Commonwealth of Kentucky Hickman County and Circuit, Set:

The GRAND JURORS, duly empanelled, sworn, and charged to enquire for said Commonwealth, and the body of the County aforesaid at the October term of the Hickman Circuit Court in the year 1839 upon their oaths present that Samuel P McFall oath of said County yeoman on the 1st day of October in the year 1839 to wit at the county and Circuit aforesaid did presume to sell by retail at and upon a certain race filed in said County Brandy, Whiskey, Rum & Gin without first having obtained a license to keep a tavern contrary to the form of the statute in that case made and provided, and against the peace and dignity of said Commonwealth.

To the Sheriff of Hickman County, Greeting:

We command you to summon Samuel P McFall to appear before the Judge of Hickman Circuit Court, at the Court-House in the town of Clinton on the first day of the next April term, to answer a certain Presentment of the Grand Jury, against him at the October term, 1839 for retailing on a certain race field in Hickman County Brandy, Whiskey, Rum & Gin against the peace and dignity of the Commonwealth of Kentucky; and have then and there this writ. Witness WHH Taylor Clerk of our said Court, at the Court-House aforesaid this 21 day of November 1839 and in the 48 year of the Commonwealth. WHH Taylor.

You are likewise commanded to summon Thomas Griffey and William Mahan to appear at the time and place aforesaid, as witness on behalf of the Commonwealth in said case. WHH Taylor

To the Sheriff of Hickman County, Greeting:

We command you to summon John H Tyler, George Taylor and William Raines to appear before the Judge of our Hickman Circuit Court at the Court-House in Clinton, on the 2 day of our April term, to testify and the truth to speak in behalf of the Commonwealth in a certain matter of controversy now in our said court depending, wherein the commonwealth plaintiff and said Samuel P McFall is defendant and this you shall in no wise omit under the penalty of 100 pounds, and have then there this writ.

Witness Wm HH Taylor, Clerk of our said Court, at the Court-house aforesaid this 21 day of Nov’r 1839, and in the 48year of the Commonwealth. WHH Taylor
