Commonwealth of Kentucky vs JL Davis 

Charges:

The Commonwealth of Kentucky Hickman County and Circuit, Set:

The GRAND JURORS, duly empanelled, sworn, and charged to enquire for said Commonwealth, and the body of the County aforesaid at the July term of the Hickman Circuit Court in the year 1839 upon their oaths present that Johan L Davis oath of said County yeoman on the 15th day of October in the year 1839 towit at the county and Circuit aforesaid did then and there as a surveyor then & there fail to keep clear of obstruction and in good repair that part of the public roads leading from Clinton to Columbus on New Rd commencing one half mile from the town line & running to said line and thence through said town agreeable to the way said road is established and with the lower dug road down the hill with Roan St to Wake St. and thence to the ferry landing, did not keep his said precinct of said road well cleared and smoothed according to law but then and there did ? his precinct of said road to be out of reforce on the 10th day of July 1839 contrary to the form of the statute in that case made and provided, and against the peace and dignity of said Commonwealth.

Kentucky, Hickman County Court set:

Ordinance, JL Davis be appointed surveyor of the road from Clinton to Columbus on New Rd commencing one half mile from the town line & running to said line and thence through said town agreeable to the way said road is established and with the lower dug road down the hill with Roan St to Wake St. and thence to the ferry landing and that for the law all at hand and within, the said bounds of said town and (?), Keep the said road in repair.

Warrant:

To the Sheriff of Hickman County, Greeting:

We command you to summon J Shain L Davis Riley to appear before the Judge of our Hickman County Circuit Court, at the Court-House in the town of Clinton on the first day of next October term, to answer a certain presentment of the Grand Jury, found against him at the July term, failing to keep the precinct of road in good repair of which he is surveyor commencing ½ mile from the Town of Columbus & running through the said town to the ferry landing against the peace and dignity of the Commonwealth of Kentucky; and have then there this writ. Witness, WHH Taylor Clerk of our said Court, at the Court-House aforesaid, this 26 day July 1839 and in the 48 year of the Commonwealth.

We command you to summon Thomas Winn to appear before the Judge of our Hickman Circuit Court at the Court-House in Clinton, on the 2 day of our April term, to testify and the truth to speak in behalf of the Commonwealth in a certain matter of controversy now in our said court depending, wherein the Commonwealth plaintiff and said JL Davis is defendant and this you shall in no wise omit under the penalty of 100 pounds, and have then there this writ.
