Will of William Gibson - 1832

In the name of God: Amen.

I William Gibson of the County of Garrard and state of Kentucky, being in usual health of my years and of sound mind and memory, thanks be to God, do make and ordain this to be my last will and Testament, (revokeing all other, which I have made) in manner and form following - viz:

I give unto my beloved wife HANNAH Gibson all my Estate both real and personal, during her natural life or widowhood, and after her death, - I will and bequeath unto my son JOHN, two hundred dollars.

I give to my daughter ELIZABETH Peach, one negro girl, named Jane, and her increase to her and her heirs forever.
I give to my son JAMES, one negro girl named Maria and her increase from this time, during his life, and then to descend to his lawful heirs forever.

I give to my son WILLIAM, one negro man named Rams - dal? to him and his heirs forever.

I give to my son SILAS, one negro girl named Emily and her increase during his life and then to descend to his lawful heirs forever.
I give to my son ELIAS, one negro woman named Milly and her three children Betsey, Lerwis and Milly, and a girl named Ann, and all their increase during his life and his wife's lifetime and afterward to descend to his lawful heirs forever.

I give to my daughter KATHARINE, one negro man named George and a woman named Charlotte, one bed of furnature one cow and calf to her disposal forever.

I give to my daughter SALLY, one boy named Wat one woman named Harrot and her two children John & James and the womans increase, to be at her disposal forever. Also one Bed and furnature, one cow and calf.

I give to my daughter RUTH, one girl named Mary and her increase, one girl named Alse and her increase, one bed & furnature, one cow and calf to be at her disposal forever.

I give to my Grandson CHARLES Gibson, son of my son ELIAS Gibson, one negro girl named Martha and her increase, to be taken care of by my son Elias, or any one of my three single daughters, it not being my wish she should be hired out, and when my said Grandson shall arrive to the age of 22 years, he shall take possession of said girl and increase, if any.

I give to my son ELIAS Gibson Forty nice acres of the land I live on, to be taken off the south side of my land so as not to interfere with any of the improvements near the mansion house, to him and his heirs forever.

I give to my three daughters KATHARINE, SALLY & RUTH, the remainder of my land not given to ELIAS, that is while they remain single, if one shall marry, the other tow shall prssess it, if two should marry the other one shall possess it, if all should marry, the land to be sold, and the money equally divided among all my children.

The balance of the property not already given away, my desire is shall be sold and the money arising from said sale after paying my just debts, shall be equally divided among all my children - and

Lastly, I appoint my friend Thomas Spilman - to this my last will and testament.

In testimony whereas I have hereunto set my hand and seal this 28th day of December 1832.

A Codicil to the last will and Testament of William Gibson, _______ by him the 28th day of December 1832.

Whereas I William Gibson by my last will and Testament of the date aforesaid, did give and bequeath unto my son JOHN Gibson the sum of Two Hundred Dollars, and he having since died, I do hereby give and bequeath the aforesaid sum of Two Hundred Dollars unto my daughter SALLY Gibson.

In testimony whereas I have subscribed my name this day of September 1836. Signed William Gibson (seal) in the presence of John B. Jennings, John Askins, Garrard County _____

I, A.R. McKee, Clerk of the Court for the County, do certify that the foregoing Will and codicil of William Gibson, dec'd. was produced to Court at the May County Court, 1837. And offered for records by E.B. Jennings, the Executor named in the codicil (which was not ordered to be recorded). And Elias Gibson one of the devisors of the decedent and was contested by Elizabeth Peach, another one of the devisors of said descendants. And leave was given the executor and devisors to take the deposition of James T. Ison's son and Timothy Ford ______ and ordered to be continued afterward. In the July Court again produced unto Court and upon examination of John Ison, a witness in person, on oath, and the deposition of Timothy Ford, another subscribing witness, thento and no person appearing opposing the recording of said Will that was approved and ordered to be recorded. And to said Will the codicil was proven by the oath of John Askins, a subscribing witness, thereto as well as to sanity of Testator as to the handwriting of John B. Jennings, another subscribing witness. Thereto approved and ordered to be recorded. Whereupon the said Will and codicil are turly admitted to record 25 July, 1837. signed Alex R. McKee, Cl. by Bob P.
