Transcription of the Will of Jacob Tipton, Estill County, Kentucky

I, Jacob Tipton of Estill County KY being of sound mind and Memory & calling to mind the uncertainty of life & the certainty of death do make & constitute this my last will & testament revoking all former wills made by me ~

 

FIRST I will & desire that all my Just debts & funeral expenses be paid after my death—

 

SECOND I hold [illegible] deeds on Low Creek in Estill County KY one from Sam Ginter & wife and the other from Solomon Tipton & now notwithstanding the said deeds said land was bought & paid for by my son H. B. [Hugh Banks] Tipton out of his money means & I now will & bequeath same to him & same not to be estimated as any part of my estate

 

THIRD After the death of myself & wife I will & bequeath to my son H. B. [Hugh Banks] Tipton all my real estate in Estill County KY but he is to pay to each of my daughters fifty dollars cash & same to be paid after the expiration of two years from the death of myself & wife provided however should I or my wife become unable from age or any other cause to support our selves & have to be taken care of then my daughters are to contribute rateably [sic] with my son to our support or to the support of either of us & same to be taken out of the part or parts willed to each

 

FOURTH No charge is to be made & no account to be taken against any of my Children or Sons in law for any rent of land or timber taken off of my land by them or either of them during my life

 

FIFTH I will & bequeath all my personal property to my beloved wife should she be the longest liver in testimony where of I have hereunto set my hand & seal this 10th day of Nov 1881

This day produced in open court after perporting [sic] to be the last will and testament of Jacob Tipton decd which was proven by the oaths of Robert Briddell and Samuel L. Tudor the two subscribing witnesses thereto & that they witnessed the same at his request.  Whereupon said will was probated & ordered to be recorded which is done accordingly This September the 21st 1885
