Last Will & Testament


Submitted by Kimberly Lewis to the Boyle County website.

I JANE WHELAN, of Boyle County in the State of Kentucky, do make and publish this my last will and testament.

1st I devise my just debts, which may be owing by me at my death and my funeral expense be paid.

2nd In addition to the legacy of three thousand dollars given by my deceased brother JOHN WHELAN to my faithful servant BELL WHELAN, I give to her the sum of one thousand dollars. I also give to her all the furniture of every kind in the room usually occupied by me, all of my weaving apparel of every kind, one set of silver tea spoons, and two pictures one known as the "Pet" and the other as the "Picnic".

3rd I give to my servant KITTY WHELAN all the furniture of every kind, in the room adjoining my room on the east and which was occupied by my late sister MISS MARY ANN WHELAN.

4th I give to my cook MARY WHELAN the sum of five hundred dollars and one cow.

5th I give to my servant boy EUGENE WHELAN cart and horse and one cow, and I also give him all my farming utensels (sic). I further direct my executors to invest the sum of one thousand dollars in some profitable way in his name as my executor and to pay over the annual or semi-annual intrust of profits on such sum to said EUGENE for and during his natural life and at his death to pay the same to the persons who may be his heirs at law.

6th My kitchen furniture and utensels and the furniture in the rooms usually occupied by the servants, I desire to be equally divided between said boy EUGENE WHELAN and my said cook MARY.

7th I give to my friend O. BEATTY of Boyle County Kentucky the oil painting which hangs over the mantel piece in my sitting room, or front parlor as a memento of my respect.

8th All the rest and residue of my estate of every kind real and personal to include all money, chases(?) in action, bonds or stocks which I may own at the time of my death, I give to my niece MRS. MARY JANE BALL of Covington Kentucky, to be her separate and individual property, not liable to the debts of her husband, and with power to sell and convey the real estate, the proceeds of which to be her separate estate.

9th I nominate and appoint ORMOND BEATTY of Boyle County Kentucky, Executor of this my will.

I make this codicil to the forgoing will:

I give my watch being the watch which was used by and belonged to my brother JOHN WHELAN in his lifetime to my faithful servant BELL WHELAN.

I give the sum of two hundred dollars to ELLA WHELAN the daughter of my cook MARY.

I JANE WHELAN make and publish this codicil to my foregoing will:

I devise my house and all grounds thereto attached between twenty and thirty acres and setuate (sic) in and near the town of Dansville Kentucky to my great niece LETITIA OLMSTEAD to be her separate estate, and not liable to the debts or control of her present or any future husband. I give to my servant boy EUGENE my rockaway (?) in addition to the other property I have given him with the exception of the changes made in this codicil I republish the foregoing will and codicil heretofore made.

I REED S. NICHOLS clerk of Boyle County court do certify that the foregoing will of JANE WHELAN dec'd was presented to court at its August term 1877 and duly proven by the oaths of R.P. JACOBS and A.R. McKEE subscribing witnesses hereto and ordered to be recorded which is now done.
