This indenture made and entered into this the 16th day of August 1866. R. B. Evans as commissioner under a judgement of the Barren county court of the first part and Mary Wyatt of the second part. Unto forth that whereas at the April term 1866 if the Barren county court in a suit pending in which J. H. Steenbergen , Martha Britt, George Britt, Joseph Wyatt and Martha Wyatt (widow) are plaintiffs against James M. Wyatt , Rebecca Henderson, Thomas Henderson, Mary Wyatt, ____ Whitney, and the unknown heirs of Sally McGinnis (deceased) defendants.

 A judgement was rendered by which it was ordered and judged that the lands mentioned in said suit containing 225 acres be set apart in lots as follows; to plaintiffs; J. H. Steenbergen, 1/4 and 1/8 of 1/4 to plaintiffs Joseph Wyatt the same. To defendant James M. Wyatt the same. To plaintiffs Martha Britt and Martha Wyatt each 1/8 of 1/4. To defendants Mary Wyatt, Rebecca Henderson each 1/4 of 1/8 of 1/4, and the unknown heirs of Sally McGinnis 1/8 of 1/4 of said land .

 W. Wright , K. P. Ellis and G. A. W. Ellis were appointed commissioners to execute said judgement and whereas at the June term 1866 of said court said commissioners filed their report in open court having among other things that they allotted to Mary Wyatt party of the second part containing 7 ½ acres and bounded as follows: Beginning at a dogwood and black oak bush corner to ___ poles to a hickory and 2 dogwood near the ___ road S 9 W 55 poles to a cherry and chestnut ____ road W 60 E 28 poles to an elm and black gum corner to four with the same. N 4 E 50 poles to the beginning lot of land is situated in the county of Barren and state of Kentucky on  the waters of Peter’s Creek and whereas further at the July term 1866 if said court a judgement was rendered confirming the report of said commissioners to convey the lands to the persons entitled there to as shown by said report.

Now therefore in consideration of the premises and by virtue of the authority vested in me as commission under said judgement, I do hereby for and on behalf of the heirs at law of John Wyatt (deceased) convey the said land as above described to the said Mary Wyatt. To have and to hold unto her and her heirs and assigns forever and I agree to warrant and defend the title of said land to be free from all claims whatever so far as I am authorized and empowered by said judgement to do.

As Judge of the Barren county court, I have examined the written deed and approved it.

 I J.P. Nuckols clerk of the county court of for said county, certify that the foregoing deed from said commissioners to Mary Wyatt , was on the 20th day of August 1866 that being county court day for Barren county filed in open court by the said Evans and acknowledged by him to be his act and deed examined and approved by the court ans so endorsed and the same having been filed in my office for records duly stamped ___ together with the testimonials thereon endorsed and this certificate have been this day recorded.                                        Given under my hand this 2nd day of February 1870.
