Sir: 

    I have the honor to acknowledge the receipt from your Office of application for Pension No. 68176, and to return it herewith, with such information as is furnished by the files of this Office.

    It appears from the Rolls on file in this Office, that John M. Sherry was enrolled on the 18th day of August 1863, at Scottsville, Ky in Co C 52nd Regiment of Ky Inft Volunteers, to serve one year.  On the Muster Roll of Co. C of that Regiment, for the months of March and April 1864, he is reported, "A Corporal left in hospital at Lexington Ky".  His name is dropped from subsequent Rolls.  There is no evidence of his death on file in this office.

    Brief in the case of Lemuel Catherine Sherry, widow of John M. Sherry, late a private in Co C. 52nd Ret. Ky Vols resident of Allen County and State of Ky.  Post office address Scottsville, Ky.

physical condition prior to enlistment.

Certificate.
To All Whom It May Concern



    It is hereby certified, that John M. Sherry late a Corporal in company "C" commanded by Captain Mr. Billingsly in the 52nd Regiment of Kentucky Infy Vols. Commanded by Col. S.G. Grider in the was of 1861-2 who it is alleged died whilst in said service in Bowling Green in the State of Kentucky on or about the 21st day of July A.D., 1864, in consequence of Typhoid Fever incurred in said military service, and whilst in the line of his duty, was prior to his enlistment therein, and at the time thereof, a man of good sound physical health, and was not in any way afflicted with the disease which eventuated in his death.  That I make these statements from personal knowledge, having been, prior to said soldier's enlistment, then attending family physician of the household of which he was a member.  That I was personally well acquainted with him during his lifetime, and know his physical condition at enlistment, from actual observation, and therefore make my statements respecting!
him, as medical adviser in the family.  I further state that I have carefully read over and fully understand the import and meaning of all the facts embodied in this Certificate, to which I cheerfully absent and freely subscribe, under oath and in due form of law.  That I have no interest whatsoever in this matter.

    United States of America, State of Kentucky County of Allen Sct:  On this tenth (10) day of October in the year 1864, before me T. R. Hughes a Justice of the Peace within and for the County and State aforesaid, personally appeared Doctor A.S. Walker who being duly sworn according to law, on his oath declares that the facts set forth in the forgoing certificate by him made and signed, are just and true, and that he is entirely disinterested in making said statements.  I certify that he is the identical person he represents himself to be, and that he is a regular practicing physician in this community, and is of good reputation for skill integrity in his profession.  That I have no interest in this matter.

Widow's Application for Army Pension.



State of Kentucky County of Allen SS.



            On this 9th day of September, A.D. 1864, personally appeared before me (1)??_____ of the (2) County Court, a Court of Record, within and for the County and State aforesaid, Mrs. Lemuel C. Sherry a resident of the (3) County of Allen in the State of Kentucky, aged 30 years, who, being first duly sworn according to law, doth on her oath make the following declaration, in order to obtain the benefit of the provision made by the act of Congress approved July 14, 1862:  That she is the widow of John M. Sherry deceased, who was a Corporal in company "C" commanded by Capt. John Billingsley in the 52 regiment of (4) Kentucky Infy Volunteers commanded by Col. John S.G. Grider in the war of 1861, and who died (5) whilst in the service aforesaid, at Bowling Green in the State of Kentucky on or about the 21st day of July A.D. 1864, from (6) Typhoid fever incurred in the service aforesaid and whilst in the line of his duty, (7) in the field.

            She further declares that she was married to the said John M. Sherry on the 13th day of February in the year 1862:  that her husband the aforesaid John M. Sherry died on the day above mentioned, and that she (8) has remained a widow ever since that period as will more fully appear by reference to the proof hereto annexed.



            She also declares that she has not, in any manner, been engaged in, or aided or abetted, the rebellion in the United States.  She appoints J. H. H. Woodward of Louisville Kentucky her attorney with full power of substitution and revocation in her said behalf, and authorized him to receive the Pension Certificate when issued.  Her Post Office is at Scottsville in the County of Allen in the State of Kentucky.  That her domicil of place of abode is (9) on wagon road leading from Bowling Green to Scottsville Ky about 6 miles from Scottsville the County Seat of Allen County Kentucky.  That (10) there is two children the issue of the said soldier deceased.  Isac Newton Shery borned 3rd of January 1863, William Jasper Shery Borned 3rd of January 1863 living in Allen County Kentucky

Sworn to subscribed and acknowledged before, the day and year first above written, and also personally appeared Albert Taylor and Francis Williams residents of the (3) County of Allen in the State of Kentucky persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw Mrs. Lemuel C. Sherry (11) sign her (12) name to the foregoing declaration; and they further swear that they have every reason to believe, from the appearance of the applicant and their acquaintance with her, that she is the identical person she represents herself to be, and that they have no interest in the prosecution of this claim.\

Parole Proof of Marriage

Joint Affidavit


            We, Francis Williams and Albert Taylor residents of the County of Allen in the State of Kentucky upon our oaths declare that we are personally well acquainted with Mrs. Lemuel C. Sherry Widow of John M. Sherry deceased, and who is a resident of the County of Allen in the State of Kentucky and who by virtue of the Military services of her said husband, the said John M. Sherry deceased, is now applying for Army Pension.  We were likewise personally well acquainted with the said John M. Sherry now deceased, which fact we know by general pute, and his said wife, the said Lemuel C. Sherry during the lifetime of the former, and know that they lived together as husband wife, and to be so reputed, without any question to the contrary.   We also further state, that we were present at the marriage of the above named John M. Sherry with the aid Mrs. Lemuel C. Sherry whose name before he said marriage was Lemuel C. Burton.  That we were eyewitnesses to said marriage, and saw!
the same take place.  That it occurred in the County of Allen in the State of Kentucky on or about the 13th day of Feb A.D. 1862.  That Mr. H. Ham a Minister of the Gospel administered the rites of Marriage between said parties, and pronounced them man and wife.  That we make this affidavit as a simple act of justice, and nothing further, having no interest in so doing whatsoever.

Claim of Guardian of Orphan Children Pension.



The State of Kentucky, County of Warren, SS.



            On this 4th day of March, A.D. 1869, before me, (1) clk W of the County Court in and for the County and State above named, personally appeared Reubin Sherry, a resident of in the County of Allen, and State of Kentucky, aged Sixty Five years, who being first duly sworn according to law, doth on oath make the following declaration as guardian of the minor children of John M. Sherry, deceased, in order to obtain the benefits of the provision made by the act of Congress approved July 14, 1862, granting pensions to minor children under sixteen years of age of deceased officers and soldiers:  The mother of said wards was named Mary J. Taylor.  A copy of the Marriage Record of said John M. & Mary J. Sherry is here filed.

            That he is the guardian of Sarah F. Sherry born 28th day of January 1850, Nancy L. Sherry born 18th February 1853, Elmira E. Sherry born 25th Febry 1856.  Patsey A. Sherry born 27 Aug 1861, Alice R. Sherry born 29th day of December 1858 whose father was a Private in Company C commanded by Captain Billingsly, in the 52nd Regiment of Ky Vols Mo Inty Volunteers, in the war of 1861, and that the said John M. Sherry died at Bowling Green, Ky on or about the 21st day of July 1864, by reason of Typhoid fever in Hospital.

            That the mother of aforesaid children died about 8 years past leaving the above children without estate and they now depend upon their grandfather & guardian herein for support, said John M. Serry married again married whose widow by 2nd marriage is now living named Catharine Sherry having two children living  by said John M. Sherry.  He further declares that the parents of his said ward were married in Sumner County Tennessee on the 19th day of November 1848 by Bi???? Z. Turner and he also declare that he has not in any manner been engaged in, or aided or abetted the Rebellion in the United States.  I further ??? that said Catharine L. Sherry, the 2nd wife of said John M. Sherry is now living unmarried and ??? any pension on account of herself and two children, said pension does not emb?? The wards herein.  My Post Office is "Scottville Ky"

            I, Nancy V. Wright of Warren County, Ky say that I was acquainted with John M. Sherry and his wife Mary J. Sherry in their lifetime and during their married state and say their was born to them as the fruit of their marriage the following named children who are now living - Ky, Sarah F. Sherry who was born 28th day of January 1850, Nancy L. Sherry who was born 18th day Feby 1853.  I was present and saw these children born and know that they were born at the time herein stated.  They are now living with their grandfather Reubin Sherry.  Their said mother and father are dead.  Catharine L. Sherry the 2nd and last wife of said John M. Sherry is now living and drawing a pension.  I have no interest in any pension claim said children may have

Allen County



Sidney W. Pruitt states that he is acquainted with the children of John M. Sherry deceased (to witt Elmira E. Sherry, Alice R. Sherry and Patsy A. Sherry all of whom made their homes at their Grandfather's in this county (Reuben Sherry from the date of their fathers death up to this date and are now living with him.  The Said Pruitt also states that he is acquainted with Sarah Francis Sherry and Nancy S. Sherry two other children of John M. Shery decd. Both of whom to his knowledge lived with their stepmother Lemuel C. Sherry from the time of their fathers death until 19th August 1864 and he also states that they went to and have their home at their grandfathers, Reuben Sherry and that all 5 of the children above named have been under his care and protection from the dates above given and are now with him and under his care - protection.



I said S.W. Pruitt also state that I have no interest in the prosecution of this claim whatever.
